GENERAL AGREEMENT. The mare owner agrees to breed the designated mare to the servicing stallion by the chosen breeding method during the 2006 breeding season.  Breeding season begins February 1, 2006 and ends July 1, 2006.  A copy of the mare’s registration papers should accompany this contract as well as a no-refundable, non-transferable $200 booking fee which will reserve the breeding and will be deducted from the total breeding fee.  The remainder of the breeding fee shall be paid when the mare arrives for breeding or before a shipment of semen is sent.  For your convenience, we do accept Master Card and Visa. A 3% transaction fee will apply.

ON PREMISES BREEDING. All mares must arrive at Silver Buckle Farms sound to breed, halter broken and with a current negative Coggins test and health certificate. It is recommended that the mare be cultured and deemed clean and sound to breed by a veterinarian. The mare owner agrees to pay all veterinary fees as they occur. The mare owner should expect to pay the fees for a minimum of two ultrasound examinations. A daily board charge of ______________ shall be assessed. Mare being bred via artificial insemination on the farm will be assessed a one time insemination fee of $100 Mares being hand bred will not be charged an additional fee (available only for the stallions, This Mr. Looks Good and Mr. Fancy Choice)

SHIPPED COOLED SEMEN. Shipped semen is only available for mares breeding to Ziploose N Fancyfree. There will be an initial $250 chute fee AND a $200 collection fee for the first shipment.
For additional shipments only the $200 collection fee will apply. Silver Buckle Farms will pay the FedEx charges for the first two shipments. Counter-to-counter shipping is not available. Silver Buckle Farms should be notified on the first day the mare shows signs of heat. Semen requests must be received no later than 8:00 a.m. (central time) on regularly scheduled breeding days (Mondays, Wednesdays and Fridays). Silver Buckle Farms must be notified by 10:00 a.m. (central time) to cancel the shipment or a $150 collection fee will apply. The receiving mare must be inseminated by a qualified licensed veterinarian or all guarantees are null and void. Mares on the premises have breeding priority, therefore the availability of shipped semen in not guaranteed for a specific day. The mare owner shall assume the risk and expense associated with a lost or delayed shipment and shall hold Silver Buckle Farms harmless.

GUARANTEES. 

LIVE FOAL.  The stallion owner guarantees a live foal. Live foal is defined as a foal that stands and nurses without assistance. If the mare is not in foal, aborts the foal, or if the foals dies within 24 hours of birth, the stallion owner shall be held harmless from all liability, and the mare owner is entitled to one complementary rebreed for the following year only, for the same mare to the same stallion. (Substitutions may be allowed with the consent of the stallion owner).

COLOR GUARANTEE FOR COLOR BREEDERS.  If the foal does not qualify for regular registry the following guarantees apply:
                1.  Solid Filly - mare owner shall receive a rebreed for the following year at half the advertised breeding fee.
                2.  Solid Colt - mare owner shall receive a free rebreed the following year.  There is no color guarantee on rebreeds.

There is no color guarantee on rebreeds. For any rebreed resulting from a nonviable or non-colored colt, any applicable mare care, veterinary, collection and shipping fees will be charged. At the end of that following breeding season, the right to rebreed is canceled and the stallion owner is released from any further obligation whatsoever. Should the stallion be sold, die or otherwise become unfit to service, the stallion owners liability shall be discharged fully, and the new owner will be obligated to honor the terms of this contract. Under Missouri law an equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting form the inherent risks of equine activities. The mare owner agrees to look solely to his insurance for compensation for any injury, sickness, health or loss of any kind.

PAYMENT.  All fees must be paid in full before a shipment of cooled semen is sent, or the mare is released from the farm. All invoices are due and payable within fifteen days of receipt to avoid an 18% per annum late fee. Payment past due thirty days will be considered a default and the stallion owner is entitled to exercise all legal remedies available to collect the amount due at the mare ownerís expense. A breederís certificate shall be issued upon notification of the birth of the foal, providing all accounts have been paid in full by the mare owner.


Mare owners signature attests to the fact that the owner has read and understood all of the terms outlined herein and accepts this contract as a legal and binding instrument in the state of Missouri. This contract cannot be assigned or transferred.
